Tasman Capital Investments (Australia) Pty Ltd (ACN 114 016 698) (AFSL 315809) (“Tasman”, “we”, “our” or “us”) is a private equity fund manager based in Australia. This Privacy Policy applies to the Tasman Capital Partners group of companies including Tasman Capital Investments (Australia) Pty Ltd, Tasman Capital Partners Investment Management Pty Ltd (ACN 688 121 708) and each entity managed or controlled by the aforementioned entities or their Related Entities (as that term is defined in the Corporations Act 2001 (Cth)). You may contact us at any time for a current list of the entities this Privacy Policy applies to.   

At Tasman, we recognise the importance of protecting your personal information and are committed to protecting the privacy of your personal information.  This document sets out our policy on how we collect, handle, store and protect personal information.

This policy applies to Tasman as well as agents and contractors engaged to provide products and services on Tasman’s behalf. 

When handling personal information we comply with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (“the Privacy Act”) which impose regulations on the way in which organisations collect, store, use and disclose personal information and other matters including data quality, security, openness, access and correction. 

2. Types of personal information we collect and store

What personal information do we collect and why?

The Privacy Act defines “personal information” as any information or an opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable from the information or opinion.

The personal information we collect includes, but is not limited to, names (current and former (if any)), personal and business contact details (including your address, mobile and landline telephone numbers and email address), date of birth, employment details (including company name and job title), personal identification, bank account details, tax information (including your tax file number and ABN if applicable),  contact and identification details of any third party authorised to act or provide personal information on your behalf (including agents or attorneys appointed under a power of attorney), social media details and your preferences and interests about our services (likes and dislikes). We also collect any correspondence between you and us and any other personal information provided to us when an inquiry is made, information is requested or a complaint is lodged.

In addition, we collect personal information in relation to prospective employees and contractors including curriculum vitaes, employment history, job applications and reference checks.

We may collect personal information directly from you when we:

  • receive requests for information from you through our website, by telephone, email or in writing;

  • are provided with your contact details, business cards or documents containing your personal information for the purpose of confirming your identity or for our “know your customer” investigations under the Anti-Money Laundering and Counter-terrorism Financing Act 2006 (Cth);

  • receive inquiries from you about investing with us;

  • meet with you in person or via video conference;

  • are engaging with you for the purpose of delivering services to you; and

  • are performing other activities that form part of the operation of our business, but which do not directly form part of providing services to you.

    We may also obtain your personal information from third parties, including:

  • recruitment firms, where necessary to facilitate an employment or contractor relationship with you;

  • our clients;

  • your business colleagues, partners, authorised agents or attorneys;

  • the companies we invest in;

  • our professional advisers (including our lawyers, accountants, consultants, auditors and insurers);

  • referees and third parties in relation to prospective employees and contractors as part of our recruitment process; and

  • suppliers, contractors and third-party service providers that we engage to help us operate our business.

    Due to the nature of the services we provide, it is only practicable or reasonable for us to transact and correspond with you on a named basis. Your personal information may be required in order to provide you with our services, or to resolve any issue you may have.

In some instances we may collect personal information from you that is unsolicited. To the extent reasonable, we will delete or de-identify any unsolicited personal information.

Pseudonyms and Anonymity

In limited interactions with us, you may have the option to deal with us anonymously (for example, if you contact us for general information). Otherwise, it is not possible for us to engage in a business relationship with, or deliver services to, individuals whose identity we are not reasonably able to ascertain.  Choosing not to identify yourself when dealing with us may mean that we are not able to provide you with the products or services you ask for or require.

Website analytics

To improve your experience on our website, like most major websites we may use methods (including cookies and enhanced conversions) as tools to remember your preferences and track your interactions with our website.

You may refuse the use of these methods by selecting the appropriate settings on your browser or mobile device, or managing your consent preferences within Google; however, if you do this, you may not be able to use the full functionality of our website.

Our website may contain links to other websites. We are not responsible for the privacy practices of such other sites. When you go to other websites, you should read their privacy policies. 

Our website is built and hosted on Squarespace. Squarespace collects certain information automatically from visitors to help us understand website traffic and usage. This may include your IP address, browser type, device information, pages visited, and interactions with our site. Squarespace uses cookies and similar technologies for analytics purposes.

Our associated companies' websites may use the analytics tool Google Analytics. This service transmits data regarding your activity on these websites to Google servers that may be located outside of Australia. Google Analytics does not identify individual users or associate your IP address with any other data held by Google.

 By using our website, you consent to the processing of data about you by Squarespace in the manner described in Squarespace’s Privacy Policy and for the purposes set out above.

How we use personal information

We use the personal information that we collect as permitted by this Privacy Policy for the following reasons:

  • to answer queries you may have about our products and services and provide you with information you have requested;

  • to provide services to our clients;

  • to accept an investment from you;

  • in the management and administration of our investments including any new acquisitions and the potential sale of any current investments;

  • to maintain and administer our relationship with you (for example, to update our records);

  • to communicate with you;

  • in undertaking marketing and business development activities with our clients and prospective clients;

  • to seek feedback on our services;

  • to facilitate our internal and external business processes, including financial operations, training and reporting;

  • to notify you about important changes or developments to our services;

  • to allow us to assess the suitability of prospective employment candidates;

  • if you lodge a complaint with us, to investigate and respond to your complaint;

  • as required or authorised by law; and

  • for such secondary purposes that are closely related to the purposes above in circumstances where you would reasonably expect such use or disclosure.

When will we disclose your personal information?

We will only disclose your personal information as set out below. Importantly, we will never disclose or sell your personal information to third parties for advertising purposes or for any other purpose without your authorisation.

We may disclose personal information to:

  • other entities that we own or control;

  • third parties where you consent to the use or disclosure; and

  • third parties that we engage to assist us in providing services to our clients or in the operation of our business (for example, our subcontractors, advisors, suppliers and financial institutions (to process payments)).We may also disclose personal information when required by law.

We may share non-personal, de-identified and aggregated information with third parties for several purposes, including research, questionnaires, submissions, marketing and promotional purposes.

Security of personal information

Your personal information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

We hold personal information in hard copy and electronic formats. We use a range of physical, operational and technological security measures to protect this information including firewalls, password protection and premises access restrictions.

3.Transfer of personal information outside Australia

Tasman’s IT and data service providers may store your personal information within services provided by cloud service providers located in overseas countries, including the United States of America. 

Otherwise, Tasman will only send your personal information outside Australia with your consent or if Tasman is authorised or required to do so by law.

By providing Tasman Capital with your personal information, you consent to the disclosure and transfer of your personal information to the overseas recipients referenced above based in countries with privacy laws that are different from the privacy laws that apply to this Policy.

Please note that there are various online applications, such as Linkedin, that allow you to share content with other users that may be linked to our website. If you choose to “like” or “share” information from our website through these services, you should review the privacy policy of that service. Any personal information that you contribute to these services and applications can be read, collected and used by other users. We have little or no control over these other users and, therefore, we cannot guarantee that any information that you contribute will be handled in accordance with this Policy.

4. Access to, or correction of, your personal information

You may access your personal information or seek to have that information corrected if you believe that it is incorrect at any time.

To protect your personal information, we may require identification from you before releasing the requested information.

How long do we store information for?

We will not keep your personal information for longer than is required for the purposes for which the information may lawfully be used.
